These Terms of Service (“Terms”) govern your use of ApartmentsAds.com and its related services. By using the site you agree to these Terms. If you do not agree, do not use the site.
ApartmentsAds.com is a national real estate advertising platform operated by LACMS Platform, a division of BostonApartments.com. We provide an online marketplace for landlords, property managers, and agents to advertise properties and for users to search for housing. We are an advertising intermediary — we are not a party to any rental, sale, or lease transaction.
You must be at least 18 years of age to create an account or post a listing. By registering, you represent that you meet this requirement. We reserve the right to terminate accounts of users who misrepresent their eligibility.
You are responsible for all activity under your account. Keep your password secure. Notify us immediately at support@apartmentads.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account where you failed to take reasonable security precautions.
By posting a listing on ApartmentsAds.com you grant us a non-exclusive, royalty-free licence to display, distribute, and syndicate that listing across our sister platforms (BostonApartments.com, ApartmentsUSA.com) and approved third-party feed partners. This licence terminates when you withdraw or expire the listing.
You retain ownership of content you submit (listing descriptions, photos). By submitting content you represent that you own or have the right to use it and that it does not infringe any third-party rights. ApartmentsAds.com and its underlying platform (LACMS) are the intellectual property of BostonApartments.com. You may not scrape, copy, or reproduce site content without written permission.
If you believe content on ApartmentsAds.com infringes your copyright, send a notice to dmca@apartmentads.com containing: (a) identification of the copyrighted work; (b) identification of the infringing content and its URL; (c) your contact information; (d) a statement of good-faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your electronic or physical signature. We will respond within 10 business days.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT VERIFY THE ACCURACY OF LISTINGS. ALWAYS INDEPENDENTLY VERIFY A PROPERTY BEFORE PAYING ANY MONEY OR SIGNING ANY AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APARTMENTADS.COM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY LISTING INFORMATION. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless ApartmentsAds.com, its operators, officers, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your listings, or your use of the site.
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in state or federal courts in Suffolk County, Massachusetts, for intellectual property infringement. You waive any right to participate in a class action.
If you are located in the EU or UK, nothing in these Terms limits your statutory rights under applicable consumer protection laws. In the event of a conflict between these Terms and applicable mandatory EU or UK law, the applicable law prevails to the extent required.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account by emailing support@apartmentads.com. Sections 6, 8, 9, 10, and 11 survive termination.
We may update these Terms at any time. We will provide at least 30 days’ notice to registered users of material changes. Continued use after the effective date constitutes acceptance.
